
I thought we are alone! So much of paper work during this age of digitalisation?
My view is that as a lawyer my job is to provide assistance to court for expeditious disposal of the case but too much of paper work which is presently expected from a lawyer practically turns him or her into clerk-lawyer. Very often a lawyer has to meet formal objections of court registry which are outrageous but you have to do it because your matter will not be listed unless you clear the objections. This is due to feudal system of providing complete paper book to “My Lords”. The digital technology enables the judicial system, if they so desire, which can consolidate all records, from court of first of first instance to the highest court, duly referenced so that court can directly go to the points of relevance. Frankly, not only courts but even our lawyer fraternity is not keen to improve the system. They want to continue with the system as it exists. My repeated suggestions that we should provide cost and time effective judicial system to litigants has no impact. Consider, what is necessity of going to Oath Commissioner when authenticity can be ensured online with digital signatures. All this requires a will to change which is presently lacking both in courts as well as legal fraternity. First, we have to create a feeling in us that we are duty bound to provide cost and time effective system to the parties seeking conflict resolution. Feudal mentality has to be given up, whether it is India, USA or elsewhere.
