This is what was said in my yesterday’s post (https://lawyerics.law/project/2025-08-06-strained-judicial-system/). The Supreme Court does not have constitutional power to boss over the High Courts. The High Courts are not the courts subordinate to the Supreme Court. The Supreme Court has power only to overturn or modify the High Court ruling but cannot oversee the functioning of the High Courts. The kind of outburst the Supreme Court expressed in its ruling shows that the judicial is under considerable stress and is not at present able to implement and develop law dispassionately. Its ruling are temperamental which are antithetical to judicial norms. Hon’ble Supreme Court, please shed your political ambition to take over Government functions, shed the workload which you have unnecessarily undertaken by way PILs and other similar matters, and confine yourself to your core functioning. It is not good for the nation that a ruling is given today and it is doubted tomorrow. It shows that judicial system has strayed from its path. Kindly consider after how many years Roe v. Wade was reviewed by U.S. Supreme Court. In India, one is not sure whether law laid down by the Supreme Court will remain stable even for one year.
